YALA CLINICIAN CHARGED WITH DEFILING 14-YEAR-OLD GIRL AFTER ODPP REJECTS DIVERSION

A Yala-based clinician has been arrested and charged with the defilement of a 14-year-old girl following directives from the Office of the Director of Public Prosecutions (ODPP).

The suspect, identified in court documents as Vincent Omwenga, is currently in police custody facing multiple counts under the Sexual Offences Act.

According to the charge sheet dated October 29, 2026, and filed under court file number E028/2026, the clinician faces a primary charge of defilement contrary to Section 8(1) as read with Section 8(3) of the Sexual Offences Act No. 3 of 2006. He is also charged with committing an indecent act with a child contrary to Section 11(1) of the same Act.

Investigators state that the offenses occurred on diverse dates between January 2026 and August 23, 2026, within Gem Yala Sub-County in Siaya County.

The case file review highlights that the matter initially faced a recommendation for diversion from an assistant director of public prosecutions. However, the ODPP formally rejected diversion following a review of the inquiry file submitted by the National Police Service (NPS).

In a press statement released on October 29, 2026, the ODPP reiterated that under its policy guidelines and the law, sexual offenses shall not be diverted and must instead be handled strictly through the applicable legal framework.

‘’The ODPP reaffirms its commitment to upholding the rule of law, promoting accountability, protecting vulnerable persons, and independently, impartially, and effectively discharging its constitutional mandate,” the statement read.

The suspect remains in custody as court proceedings get underway.
